Website use and access to Pardo’s business services.
1. Operator and scope
Pardo Foods is a brand operated by Fresh Produce Industry, LLC. In these terms, “Pardo,” “we,” “us” and “our” refer to Fresh Produce Industry, LLC.
These terms describe the rules for the Pardo Foods website and its forms. The site is intended for adult, authorized representatives of restaurants, cafés, hotels, supermarkets, institutions, wholesalers and other food businesses. Delivery coverage is confirmed for each business address.
Visiting the site or completing a form does not sign a customer agreement or personal guaranty. Any required contractual acceptance or specific consent will be presented clearly in the relevant process.
2. Applications, accounts and private pricing
Provide accurate, current information and only details you are authorized to share. If acting for a business, you must have authority for the action you take.
An application or acknowledgment of receipt does not mean approval, account opening, credit, product reservation or acceptance of an order. Pardo verifies the business and applicable requirements before approving and activating an account. Pricing is available only to approved, active customers through authorized access.
Credentials are for the business’s authorized users. Do not publish, sell or provide them to outsiders. Private pricing and commercial terms must not be published, resold or distributed without authorization, except as legally permitted or required. This does not restrict necessary use by your authorized buyers, employees or advisers to manage the account.
Report suspected unauthorized access. We may temporarily restrict access for a justified security, fraud, impersonation or misuse concern, subject to law and existing agreements. Such action does not remove privacy rights or valid claims.
3. Products and website information
Images are illustrative. Fresh produce may have natural variations within applicable specifications and tolerances. Varieties, sizes, packs, quantities and availability are confirmed for each transaction.
Public information describes our offering and is not a final offer to sell or a guarantee of inventory, pricing, coverage or a delivery date. We may correct website errors; a correction does not itself change an accepted order or signed agreement.
4. Orders and customer agreements
Purchases are governed by the customer agreement actually entered into, accepted orders and applicable law. Those documents establish pricing, payment, credit, delivery, receiving, claims, returns and other commercial conditions. For those matters, the transaction documents take precedence over informational website content.
Submitting a contact form, booking a conversation or applying for an account does not authorize a charge, bank debit, personal credit report or personal guaranty. Relevant authorizations are requested separately. Verify changed payment instructions through an independently established Pardo contact before acting on them.
FAQs explain the usual process; they do not replace the commercial agreement or expand anyone’s authority to act for Pardo.
5. Rewards and referrals
Enrollment and benefits follow the Pardo Rewards conditions and referral program conditions, as applicable. Participation requires meeting the program requirements; an application does not guarantee enrollment or a benefit.
These terms do not change previously recognized benefits or accepted commercial conditions. Marketing and analytics permissions are separate from program participation.
6. Permitted website use
You may browse the site and use its functions for legitimate business purposes. You must not:
Impersonate people or businesses, provide false information or submit fraudulent requests.
Attempt unauthorized access to accounts, pricing, systems or information, or bypass access controls.
Introduce malicious code, send spam, disrupt the service or use automated data extraction that bypasses restrictions or creates an undue load.
Use forms to submit another party’s confidential information without authority or unlawful content.
Represent yourself as acting for Pardo without authorization or misuse its identity to mislead others.
Do not enter passwords, Social Security numbers, full bank account numbers or card details in general forms. Use only the appropriate method provided when a transaction requires additional information.
7. Brand and content
The brand, logos, photographs, text, design and other website materials belong to Fresh Produce Industry, LLC or their respective owners or licensors. Browsing the site does not grant a license to claim them as your own, resell them or use them to imply an affiliation or endorsement that does not exist.
You may retain public information to evaluate a business relationship with Pardo, subject to applicable rights. These terms do not restrict uses permitted by law.
8. Privacy, communications and external services
Our privacy notice explains how information is handled. Optional analytics can be managed through Privacy choices. Using the site does not mean consenting to marketing or waiving privacy rights.
The site may link to or embed external services, such as the booking calendar. Their own terms and notices may apply when you use them. Pardo does not control their changes or interruptions; this does not remove Fresh Produce Industry, LLC’s own obligations.
A booking is subject to confirmation by the relevant calendar service. A booking or inquiry does not confirm an order or delivery.
9. Availability and preserved rights
The site may be interrupted by maintenance, technical issues or external services. We do not guarantee uninterrupted or completely error-free access. If a function is unavailable, use the official contact to request assistance.
These terms do not exclude liability for fraud, willful misconduct, gross negligence or other liability that cannot lawfully be limited. They do not remove nonwaivable warranties or remedies, privacy rights or applicable PACA rights. Product conditions and remedies remain governed by the applicable commercial agreement.
10. Updates and languages
We will publish changes on this page with their date and version. Material changes will be communicated through a prominent notice or another appropriate method; additional acceptance will be requested when required. Changes will not apply retroactively to alter accepted orders, signed agreements or accrued rights.
The English and Spanish versions are intended to express the same conditions. If you notice a difference, contact Pardo to clarify it before taking an action that depends on it. The applicable version of a commercial agreement will be the version the parties accepted in accordance with law.
11. Applicable law and legal communications
These terms are interpreted under California law and applicable federal law, subject to mandatory rules that apply. They do not create mandatory arbitration, a jury-trial waiver or a class-action waiver. Valid provisions in an accepted commercial agreement retain their own scope.
If a provision cannot lawfully be applied, the remaining provisions continue to have effect to the extent permitted by law. Notices subject to contractual or procedural requirements must comply with them; a general email does not replace formal notice when law or an agreement requires another procedure.
